Samhain Séance Terms, Disclaimers, Assumption of Risk & Liability Waiver

PLEASE READ CAREFULLY BEFORE PURCHASING A TICKET. THIS DOCUMENT CONTAINS IMPORTANT TERMS REGARDING ASSUMPTION OF RISK, RELEASE OF LIABILITY, AND YOUR LEGAL RIGHTS.

By purchasing a ticket, registering for, attending, and/or participating in the Samhain Séance event, you acknowledge that you have read, understood, and voluntarily agree to the following terms, disclaimers, rules, and conditions of participation.

For the purposes of this agreement, “Event Organizers” includes Sabrina, Modern Witch Alchemy, guest speaker(s), assistants, volunteers, contractors, representatives, agents, and, where legally applicable, the venue and its owners or operators.

Age Requirement 18+ Only

This Event is strictly for individuals 18 years of age or older.

By purchasing a ticket and attending the Event, you represent and confirm that you are at least 18 years old.

Valid government-issued identification may be requested to verify age. Anyone unable to establish that they are at least 18 may be refused entry without refund.

Tickets may not be purchased to a person under the age of 18.

No minors, including minors accompanied by a parent or guardian, will be admitted.

Nature of the Event

The Samhain Séance is an experiential event that may include education about Victorian séances and Spiritualism, discussion of death, spirits and paranormal beliefs, protection spellwork, ritual practices, ancestor-focused spiritual practices, meditation or altered atmosphere, and participation in a group séance.

Participants understand that these activities are spiritual, cultural, historical, experiential, and/or entertainment-based in nature.

Entertainment & Spiritual Disclaimer

This Event is provided for entertainment, educational, spiritual, and personal exploration purposes only.

Séances, spirit communication, mediumship, divination, intuitive impressions, spellwork, ritual practices, paranormal experiences, spiritual discussion, or other information shared during the Event are not medical, psychiatric, psychological, therapeutic, legal, financial, or other professional advice.

Nothing occurring during the Event should be used as a substitute for qualified professional care or relied upon as the sole basis for significant medical, psychological, financial, legal, relationship, or other life decisions.

No representation or guarantee is made regarding the existence of spirits or paranormal phenomena, the ability to communicate with spirits, or the accuracy, authenticity, meaning, identity, or source of any perceived communication or experience.

Séance Experience & No Guarantee of Spirit Activity

Every séance is different.

The nature and outcome of the séance cannot be predicted, controlled, or guaranteed.

The Event Organizers cannot control whether participants perceive spirits, ancestors, loved ones in spirit, paranormal phenomena, messages, sensations, sounds, impressions, physical phenomena, or any other form of activity during the séance.

The Event Organizers cannot guarantee communication with any particular deceased person, ancestor, spirit, entity, or other perceived presence.

Purchasing a ticket provides admission to and participation in the Samhain Séance experience itself. It does not constitute the purchase or guarantee of a particular paranormal, spiritual, emotional, or supernatural outcome.

The absence of perceived spirit communication or paranormal activity does not mean the Event was not delivered as advertised and, by itself, does not entitle an attendee to a refund.

Participants understand that Sabrina cannot control whether, when, how, or if perceived spirit communication occurs.

Personal Interpretation & Individual Experiences

Experiences during a séance may vary significantly from person to person.

Any messages, sensations, emotions, impressions, images, thoughts, sounds, intuitive information, perceived communications, synchronicities, paranormal experiences, or other occurrences are subject to individual interpretation.

Participants are solely responsible for deciding what meaning, if any, they assign to their experiences.

The Event Organizers make no guarantee regarding the identity or source of any perceived communication.

Participants remain solely responsible for decisions or actions they take following the Event.

Respect for Spirit & the Séance

Respect is a fundamental condition of participation in this Event.

Participants agree to approach the séance, ritual practices, ancestors, loved ones in spirit, other participants, and differing spiritual beliefs with respect.

Intentionally mocking, provoking, antagonizing, challenging, taunting, or deliberately disrupting the séance or spiritual practices is not permitted.

Participants who behave in a manner that the host reasonably believes is significantly disruptive, disrespectful, unsafe, or interfering with the experience may be asked to stop participating or leave the Event with NO refund.

Voluntary Participation & Right to Step Away

Participation in the séance, protection spellwork, rituals, meditation, discussions, demonstrations, spiritual exercises, and other Event activities is voluntary.

Participants are never required to engage in a spiritual or ritual practice that conflicts with their beliefs or personal boundaries.

You may decline an activity or step away if you become uncomfortable.

Participants are responsible for communicating their boundaries and making choices appropriate for their own physical, emotional, psychological, spiritual, and personal comfort.

Choosing not to participate in an individual portion of the Event does not ordinarily entitle the participant to a full or partial refund.

Emotional & Psychological Considerations

The Event may involve discussion or experiences relating to death, deceased loved ones, grief, ancestors, spirituality, spirits, paranormal phenomena, mortality, and other potentially sensitive subjects.

These subjects may produce unexpected or intense emotional reactions.

Participants voluntarily accept the possibility that they may experience sadness, fear, grief, anxiety, discomfort, excitement, emotional distress, unexpected memories, or other emotional responses.

Participants are responsible for determining whether participating in this type of Event is appropriate for them.

The Event is not therapy, grief counselling, psychiatric treatment, psychological treatment, crisis intervention, or medical care.

If at any point you feel that continuing is not appropriate for your well-being, you are encouraged to stop participating.

Protection Spellwork Disclaimer

Protection spellwork may be offered before the séance as a spiritual and ritual practice.

No representation or guarantee is made that any spell, ritual, cleansing, spiritual practice, protective technique, intention, herb, object, candle, oil, crystal, symbol, prayer, or other practice will prevent physical, emotional, psychological, spiritual, supernatural, or perceived paranormal experiences.

Participation in protection spellwork is voluntary.

Participants may participate according to their own beliefs and comfort levels.

Participants are responsible for determining whether any food, beverage, herb, oil, incense, fragrance, or other substance present at the Event is safe and appropriate for them.

Participants with allergies, intolerances, sensitivities, dietary restrictions, asthma, fragrance sensitivities, or other relevant concerns are responsible for notifying the host where appropriate and avoiding substances that may cause them harm.

While reasonable efforts may be made to communicate known ingredients or accommodate certain needs, an allergen-free environment cannot be guaranteed unless explicitly stated.

Cross-contact or cross-contamination may occur.

Each participant is responsible for determining whether they are physically and emotionally capable of safely attending and participating.

If you have a health condition, mobility limitation, allergy, sensitivity, or other concern that may affect your ability to participate safely, you are responsible for making an appropriate decision regarding attendance and obtaining professional advice where necessary.

The Event Organizers are not responsible for assessing an individual's medical fitness to participate.

ASSUMPTION OF RISK, RELEASE & LIMITATION OF LIABILITY

PLEASE READ THIS SECTION CAREFULLY.

By voluntarily attending and participating in the Samhain Séance, you acknowledge that participation in an in-person Event involves inherent, incidental, ordinary, and potentially unforeseen risks.

These risks may include, without limitation, slips, trips, falls, burns, contact with candles or ritual materials, allergic or sensitivity reactions, illness, physical discomfort, emotional distress, anxiety, grief reactions, property damage, bodily injury, and, although extremely unlikely, serious injury or death.

You freely and voluntarily choose to attend and participate with knowledge that such risks may exist.

You agree to take reasonable responsibility for your own safety and conduct.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU VOLUNTARILY ASSUME THE RISKS ASSOCIATED WITH YOUR ATTENDANCE AND PARTICIPATION AND AGREE TO RELEASE AND HOLD HARMLESS SABRINA LICHTENHELDT, MODERN WITCH ALCHEMY, GUEST SPEAKER(S), ASSISTANTS, VOLUNTEERS, CONTRACTORS, REPRESENTATIVES AND AGENTS FROM CLAIMS FOR LOSS, DAMAGE, EXPENSE, PERSONAL INJURY, ILLNESS, PROPERTY DAMAGE, OR DEATH ARISING FROM OR RELATED TO YOUR VOLUNTARY PARTICIPATION, EXCEPT TO THE EXTENT THAT SUCH LIABILITY CANNOT LAWFULLY BE WAIVED, RELEASED, EXCLUDED, OR LIMITED.

Nothing in this agreement is intended to waive, release, exclude, or limit liability that cannot legally be waived, released, excluded, or limited under applicable law.

Nothing in this agreement eliminates the Event Organizers' obligation to comply with applicable law or reasonable safety obligations imposed by law.

  • Their own behaviour and decisions

  • Following reasonable safety instructions

  • Respecting personal limits and boundaries

Possession, use, distribution, or consumption of illegal substances during the Event is prohibited.

The host may refuse entry to or remove anyone reasonably believed to be significantly impaired or whose behaviour creates a safety concern.

Removal for intoxication, unsafe behaviour, or violation of Event rules may result in forfeiture of the ticket without refund.

Respect, Consent & Personal Boundaries

All participants are expected to treat other attendees, the host, guest speaker, venue, and Event materials respectfully.

Harassment, discrimination, threats, violence, intimidation, unwanted physical contact, sexual harassment, deliberate disruption, bullying, or intentional violation of another person's boundaries will not be tolerated.

Consent must be respected at all times.

Participation in the Event does not constitute consent to physical touch by another attendee.

Privacy & Confidentiality Between Participants

Séances and spiritual gatherings may involve participants sharing personal experiences relating to grief, deceased loved ones, family, spirituality, or other sensitive matters.

Participants are expected to respect the privacy of others and not intentionally share another participant's personal story, experience, or sensitive information outside the Event without permission.

However, because this is a group Event, the Event Organizers cannot guarantee that other attendees will maintain confidentiality.

Participants should therefore use their own discretion when deciding what personal information they wish to share.

Photography, Video & Recording

Participants may not photograph, film, livestream, or audio-record another attendee without that person's consent.

The host may restrict or prohibit photography, video, audio recording, livestreaming, or other recording during any portion of the séance or Event.

Participants agree to comply with all recording instructions.

Personal Belongings

Participants are responsible for their personal belongings.

To the fullest extent permitted by applicable law, the Event Organizers are not responsible for belongings that are lost, stolen, forgotten, misplaced, or damaged during the Event.

Guest Speakers & Individual Views

Guest speakers may share historical information, opinions, personal beliefs, spiritual perspectives, experiences, or interpretations.

Unless explicitly stated otherwise, the views expressed by a guest speaker are their own and do not necessarily represent the views of Sabrina or Modern Witch Alchemy.

No guarantee is made regarding any spiritual, historical, paranormal, or personal claim expressed as an individual belief, interpretation, or experience.

The host reserves the right, acting reasonably and subject to applicable law, to refuse entry or require an attendee to leave for reasons including:

  • Being under 18

  • Intoxication or impairment

  • Unsafe behaviour

  • Threatening or violent behaviour

  • Harassment

  • Deliberate disruption

  • Serious disrespect toward participants or the séance

  • Intentional interference with ritual or safety procedures

  • Refusal to follow reasonable venue or safety instructions

  • Behaviour that substantially interferes with the safety or experience of others

An attendee removed for violating Event rules may forfeit their ticket without refund, subject to applicable law.

Emergency Situations

In the event of a medical, fire, safety, or other emergency, the Event Organizers may contact emergency services where reasonably appropriate.

Participants agree to follow emergency instructions and venue evacuation procedures.

The Event host and guest speaker are not acting as physicians, paramedics, psychologists, therapists, or emergency medical providers unless specifically identified otherwise.

Nothing in this agreement prevents anyone from contacting emergency services or obtaining appropriate medical care.

Transportation

Participants are responsible for arranging safe transportation to and from the Event.

The Event Organizers are not responsible for transportation arrangements, vehicle damage, parking issues, traffic conditions, or the conduct of third-party transportation providers.

Participants must not drive while impaired.

Event Changes, Cancellation & Circumstances Beyond Our Control

Event programming, scheduling, guest speakers, activities, or other details may occasionally need to be reasonably modified due to circumstances outside the Event Organizers' control.

The Event may be postponed, relocated, modified, or cancelled due to circumstances including severe weather, venue emergencies, government restrictions, illness, safety concerns, utility failures, natural disasters, or other events beyond reasonable control.

Any refund, credit, transfer, or rescheduling options in such circumstances will be governed by the Event's stated cancellation and refund policy and applicable law.

Ticket Transfers & Refunds

No refunds, transfers, or exchanges.

No Guarantee of Results

No specific personal, emotional, spiritual, paranormal, healing, transformational, or other outcome is promised or guaranteed.

Testimonials, stories, previous experiences, or descriptions of past séances are not guarantees that another participant will have the same or similar experience.

Severability

If any provision of these Terms, Disclaimers & Liability Waiver is found to be invalid, illegal, or unenforceable, that provision will be interpreted or limited to the extent permitted by law, and the remaining provisions will continue to apply to the extent legally permissible.

Governing Law

These Terms, Disclaimers & Liability Waiver are intended to be governed by the applicable laws of the Province of Alberta and the federal laws of Canada applicable therein, subject to any legal rights or jurisdictional requirements that cannot lawfully be excluded or altered by agreement.
